Introduction

Thank you for using Wizpop apps and other software and services provided by Grumspot, Ltd. (“Grumspot”). Grumspot's mission is to assist e-commerce businesses in creating effective popups for their online stores through their Shopify-embedded popup creation tool called Wizpop. The term “Service” in these Terms of Service (“Terms”) refers to Grumspot's popup creation apps and all related products, services, software, technologies, deliverables, and tools provided by Grumspot.

By accessing, registering for, or using the Service, or by accepting these Terms through an “I Accept” checkbox or similar method, you agree to these Terms. These Terms, along with any Order, form a legally binding agreement between you and Grumspot. If you do not agree with these Terms, you may not access or use the Service.

Changes to These Terms

Wizpop may update these Terms periodically. When changes are made, a new version of the Terms will be available through the Service. Your continued use of the Service after any changes signifies your acceptance of the updated Terms.

Orders

Access to the Service may be granted through an online Service sign-up page, printed order, or other document referencing these Terms (each, an “Order”). Orders may specify fees, the number of subscribers, duration of Service use, and additional terms.

Your Account

Your account, including any associated username and password, is for your personal use only. You are responsible for all activities related to your account. Ensure your account details remain confidential.

Term and Termination

The duration of these Terms and your right to use the Service is specified in the applicable Order. Subscriptions may automatically renew unless terminated in accordance with these Terms.

Your Use of the Service

Wizpop grants you a limited, non-exclusive license to access and use the Service for personal use, contingent on your compliance with these Terms.

Wizpop Materials and Intellectual Property

All rights, titles, and interests in the Service, underlying technology, and all content within the Service belong to Wizpop and its licensors. No rights are transferred to you.

Data

You retain ownership of data entered into the Service. Wizpop retains ownership of aggregated and statistical data about the Service's use.

Fees

You agree to pay the fees for the Service as specified in the applicable Order. All fees are nonrefundable.

Acceptable Use

You must access the Service lawfully and comply with the Shopify Acceptable Use Policy.

Security

Wizpop will implement appropriate safeguards to protect your data. You are responsible for preventing unauthorized access to the Service.

Confidential Information

Both parties agree to protect each other's confidential information.

Third-Party Services

The Service may include technology provided by third parties. Wizpop is not responsible for third-party services.

Disclaimers

The Service is provided "as is" without warranties of any kind.

Limitation of Liability

Wizpop's liability is limited to the fees you have paid for the Service in the last three months.

Indemnification

You agree to indemnify and hold Wizpop harmless from any claims arising from your use of the Service.

Links within the Service may lead to third-party websites. Wizpop is not responsible for the content of third-party sites.

Privacy and Your Information

By using the Service, you acknowledge Wizpop's Privacy Policy.

Feedback

Feedback provided to Wizpop is non-confidential, and Wizpop may use it for any purpose.

All disputes arising from these Terms will be governed by the laws of the United States and the state specified in the Terms.
